The uncertainty around Andrade El Idolo’s AEW status just got more complicated. WWE’s new non-compete clause policy could be illegal under U.S. law, according to Michael Morales, a legal analyst with Lucha Libre Online. Morales explained that under U.S. and state law, non-compete clauses must include fair compensation during the restricted period.
Morales said WWE’s reported “unpaid 90-day non-compete” involving Andrade doesn’t align with federal labor law, noting, “You can’t have a non-compete without compensation. Otherwise, it’s technically slavery—and that’s illegal.” He added that WWE can legally enforce a one-year non-compete only if they pay talent during that time. If Andrade is being forced to sit out unpaid, it could be challenged in court.
